Statement by GAZ-SYSTEM S.A. and EuRoPol GAZ s.a. on the European Commission’s Position

Photo of the article In connection with media reports on the European Commission’s position regarding the agreement to entrust operator’s responsibilities on the Polish stretch of the Yamal-Europe Gas Pipeline, GAZ-SYSTEM S.A. and EuRoPol GAZ s.a. explain as follows:
1.      The operator agreement, prior to its signing, has been reviewed, at the request from GAZ-SYSTEM S.A., by the Energy Regulatory Office in terms of the admissibility of designating GAZ-SYSTEM S.A. as the operator of the Polish stretch of the Yamal-Europe Gas Pipeline. The Energy Regulatory Office has expressed no reservations to the contents of the agreement.
2.    The agreement fulfils the European Commission’s postulated expectations, including in particular those relating to third-party access to free capacities on the Polish section of the Yamal-Europe Gas Pipeline, as well as the operator’s (GAZ-SYSTEM’s) authorisation to sign all new transmission contracts.   
3.     The operator agreement is a civil contract between parties engaged in economic activities and contains information confidential to the parties under provisions of the law on countering unfair competition. The companies are unaware of any legal basis on which they would be permitted to pass on the agreement in question to the European Commission. Up till now, the European Commission has made no request to the companies to provide the operator agreement.
4.       The companies are ready to give further clarifications regarding the operator agreement as long as this complies with regulations in this area.
