New Network Codes come into force
As of 6 April 2017, two new European Commission regulations will come into force: Commission Regulation (EU) 2017/460 of 16 March 2017 establishing a network code on harmonised transmission tariff structures for gas and Commission Regulation (EU) 2017/459 of 16 March 2017 establishing a network code on capacity allocation mechanisms in gas transmission systems and repealing Regulation (EU) No 984/2013 (CAM NC amendment).
Commission Regulation (EU) 2017/460 (Tariff Network Code, TAR NC) establishes a new network code for harmonised gas transmission tariff structures. The purpose of the new regulation is to introduce EU-wide rules that will increase the transparency of transmission tariff structures and define procedures towards setting them. The introduction of the TAR NC provides benefits to network users who will gain access to a broader range of information on the tariffs set for transmission and non-transmission services. This refers in particular to the changes that are introduced in tariffs and in the methodology for setting them. The new network code also sets the rules on the application of a reference price methodology, the associated consultation and publication requirements as well as the rules for the calculation of reserve prices for standard capacity products.
Commission Regulation (EU) 2017/459 of 16 March 2017 establishing a network code on capacity allocation mechanisms in gas transmission systems is an update of the existing CAM network code. The amended network code is complemented with new provisions that establish EU-wide rules for identifying market demand for the extension of existing cross-border interconnections or the construction of new interconnections as well as rules for the allocation of additional or new capacity, known as incremental capacity (so-called incremental procedure).
According to the amended CAM NC, the first market demand assessment for incremental capacity should be launched by the EU transmission system operators as of the date of entry of the Regulation into force, i.e. as of 6 April 2017. As part of the CAM NC update, new capacity auction dates for annual and quarterly products have also been introduced. In the case of quarterly product auctions, their frequency has also been increased – according to the new auction calendar, these will be held quarterly: in August, November, February and May for firm capacity, and in September, December, March and June for interruptible capacity. The Regulation also specifies rules for offering firm and interruptible capacities for long-term products.
