Incremental capacity project at the Poland–Ukraine border approved by the President of the Energy Regulatory Office

The President of the Energy Regulatory Office approved the incremental capacity project for market areas at the border between Poland and Ukraine. This decision paves the way for an incremental capacity auction at the GCP GAZ-SYSTEM/UA TSO point, scheduled to take place on 6 July 2026 on the GSA Platform.

By the decision of 30 April 2026, the President of the Energy Regulatory Office (URE) concluded administrative proceedings concerning the joint application by GAZ-SYSTEM and LLC Gas Transmission System Operator of Ukraine for the approval of the incremental capacity project for the market areas at the border between Poland and Ukraine. The regulatory authority concluded that the company’s proposal meets all the conditions set out in Article 28(1) of Commission Regulation (EU) 2017/459 (NC CAM), which are necessary for the project’s approval.
 

- The incremental process remains a key tool to verify actual and long-term demand for transmission services. The development of export capacity towards Ukraine requires additional infrastructure investments which can be undertaken on the basis of binding commitments of network users. Today’s decision issued by the regulatory authority enables us to proceed with the next stage where the market will, in practice, confirm the scale of this demand - said Sławomir Hinc, CEO of GAZ-SYSTEM. 

The incremental capacity auction will be held on 6 July 2026 on the GSA Platform. The prerequisite for participation is registration with both transmission system operators and acceptance of the Incremental Project General Terms and Conditions.

Incremental capacity will be offered to the market at two levels:
  • the Offer Level 1: 3 095 890 kWh/h in Gas Years from 2030/2031 to 2044/2045,
  • the Offer Level 2: 4 520 000 kWh/h in Gas Years from 2032/2033 to 2046/2047.
The project, approved by the President of the Energy Regulatory Office (ERO), constitutes the company’s response to non-binding demand indications for incremental capacity at the GCP GAZ-SYSTEM/UA TSO point, which GAZ-SYSTEM and GTSOU received as part of the assessment of market demand conducted in 2025 in accordance with the provisions of NC CAM.

Following technical and economic analyses and market consultations of the preliminary project proposal, on 7 April 2026 GAZ-SYSTEM applied to the President of the ERO for approval of the incremental capacity project for the market areas at the Poland–Ukraine border. A similar application was submitted by GTSOU to the Ukrainian regulatory authority NEURC in order to obtain coordinated approvals on both sides of the border.
