Transmission of gaseous fuels

Licence for the transmission of gaseous fuels, decisions on designation as the gas transmission system operator on the territory of the Republic of Poland and the gas transmission system operator for the section of the Yamal - Western Europe gas pipeline located in the territory of the Republic of Poland

Background

  • On 30 June 2004 r.
    The President of the Energy Regulatory Office granted the legal predecessor of Gas Transmission Operator GAZ-SYSTEM S.A. (PGNiG-Przesył sp. z o.o.) a licence for the transmission and distribution of gas for the years 2004 - 2014, and on 23 August 2010 extended the licence for the period until 31 December 2030, defining it as a licence for the transmission of gaseous fuels.
  • On 1 July 2005 r.
    The President of the Energy Regulatory Office issued a decision by virtue of which Gas Transmission Operator GAZ-SYSTEM Sp. z o.o. (previously PGNiG - Przesył Sp. z o.o.) obtained the status of gas transmission system operator for a period of one year.
  • On 18 September 2006 r.
    The Extraordinary Shareholder's Meeting transformed the limited liability company (Gas Transmission Operator GAZ-SYSTEM Sp. z o.o.) into a joint stock company (Gas Transmission Operator GAZ-SYSTEM S.A.). Consequently the company could have been designated as the gas transmission system operator for a longer period. The President of Energy Regulatory Office took the relevant decision on 18 December 2006 and designated GAZ-SYSTEM S.A. as the gas transmission system operator until 1 July 2014.
  • On 13 October 2010 r.
    GAZ-SYSTEM S.A. was designated as the gas transmission system operator on the territory of the Republic of Poland until 31 December 2030.
  • On 17 November 2010 r.
    The President of the Energy Regulatory Office issued a decision designating GAZ-SYSTEM S.A. as the gas transmission system operator in respect of the Yamal - Western Europe gas pipeline section located in the territory of the Republic of Poland, until 31 December 2025.
  • On 6 December 2018 r.
    The President of the Energy Regulatory Office issued a decision on the extension of the GAZ-SYSTEM’s license for the transmission of gaseous fuels, and the decision to extend the period of designation of the Company as the operator of the gas transmission system on the territory of the Republic of Poland.   • On 24 February 2022 r.
    Pursuant to the Act of 24 February 2022 amending the Energy Law Act, the period for which GAZ-SYSTEM S.A. was designated as the gas transmission system operator in respect of the Yamal - Western Europe gas pipeline section located in the territory of the Republic of Poland was extended from 31 December 2025 until 6 December 2068. Furthermore, in light of Article 9h(3aa) and Article 33(3aa) of the Energy Law Act added by this amendment, the licence for the transmission of gaseous fuels held by the Company also entitles it to carry out this activity on the gas pipeline owned by SGT EuRoPol GAZ S.A.

Liquefaction and regasification of liquefied natural gas: LNG Terminal.

Licence for liquefaction and regasification of liquefied natural gas, decision on designation as a LNG Terminal operator.

Background

  • On 11 May 2016, the President of the ERO granted a licence for the liquefaction of natural gas and regasification of liquefied natural gas at the LNG Terminal in Świnoujście to Polskie LNG S.A. On the same day, Polskie LNG S.A. was also designated by the President of the ERO as the operator of the LNG Terminal. Both the licence and the term of operatorship will remain in effect until 31 December 2030.
  • On 31 March 2021, a merger took place between Gas Transmission Operator GAZ-SYSTEM S.A. (as the acquiring company) and Polskie LNG S.A. (as the acquired company) (merger by acquisition - in accordance with Article 492 § 1 item 1 of the CCC). As a result, permits, licences and relieves that had been granted to the acquired company passed on GAZ-SYSTEM as the acquiring company.
  • On 10 June 2021, the President of the ERO amended the licence for natural gas liquefaction and regasification of liquefied natural gas at the LNG Terminal in Świnoujście and the decision to designate the LNG Terminal operator - by indicating Gas Transmission Operator GAZ-SYSTEM S.A. as the addressee of the aforementioned decisions.

Hydrogen transmission

Status of the hydrogen transmission system operator on the territory of the Republic of Poland and certificate of independence.

Background

  • On 17 June 2025 r.
    Following the submission to the President of the Energy Regulatory Office of an application for a certificate of compliance with independence criteria and an application for a derogation from the obligation to maintain independence in terms of legal form from gas transmission activities, GAZ-SYSTEM S.A. became by operation of law – pursuant to Article 11(1) of the Act of 21 November 2024 amending the Energy Law Act and certain other acts (Journal of Laws / Dz. U. of 2024, item 1881) – the hydrogen transmission system operator on the territory of the Republic of Poland until 4 August 2026.
  • On 27 October 2025 r.
    The President of the Energy Regulatory Office issued a decision granting GAZ-SYSTEM S.A. a derogation from the obligation to maintain independence in terms of legal form from carrying out activities related to the transmission of gaseous fuels, enabling the Company to provide natural gas and hydrogen transmission services within a single entity.
  • On 9 June 2026 r.
    Following positive opinions issued by the European Commission and the European Union Agency for the Cooperation of Energy Regulators (ACER), the President of the Energy Regulatory Office granted GAZ-SYSTEM S.A. – as the first hydrogen transmission system operator in the European Union – a certificate of compliance with independence criteria.
  • On 7 July 2026 r.
    Following the entry into force of the amending provision introduced by the Act of 11 June 2026 amending certain acts in order to deregulate the energy sector (Journal of Laws / Dz. U. of 2026, item 900), the period during which GAZ-SYSTEM S.A. performs the function of the hydrogen transmission system operator by operation of law on the territory of the Republic of Poland was extended from 4 August 2026 until 4 August 2036.
